Canadian Legal Scholars Question FATCA

Canadian law professors Allison Christians (McGill University) and Arthur J. Cockfield (Queen's University) have co-authored a paper, published March 10, 2014, “Submission to Finance Department on Implementation of FATCA in Canada.”

The law professors examine the pending implementation of FATCA and recommend that the Canadian government delay implementation of the IGA between Canada and the United States until the full implications of this law are understood and until the United States offers full reciprocity.

Professors Christians and Cockfield are concerned that while FATCA is intended to catch tax evaders, it may also impose unjustified harm on people who live around the world as non-resident US citizens and green card holders, as well as their family members and their business associates.
