SUPPORT SAME COUNTRY EXEMPTION (SCE)

PASSPORT REVOCATION PROVISION

ACA advocates for special conditions in evaluating the tax debts of US citizens overseas.  ACA is concerned that with the increase in individuals coming into compliance from overseas, the lengthy mail delivery and communication time between the IRS and overseas tax filers, the risk of error in filing from overseas can result in US citizens having their passports denied or revoked without legitimate cause.  For US citizens living overseas, a US passport is a critical document proving identification and citizenship.  US citizens living in danger zones and in politically unstable countries could be put at serious risk if their passports for erroneously revoked, confiscated or denied.  Write to your legislator today and we will see that your message is also sent to the IRS oversight for this provision as well as the US State Department.  Let them know your concerns about passport revocation for US citizens overseas.

TRANSITION TAX AND GILTI PROVISIONS

ACA advocates for a deminimus ruling for small US owned businesses overseas from the provisions of the new Transition tax and GILTI provisions signed into law under the Tax Cuts and Jobs Act of 2016.  ACA has advocated that the intent of the law was not to treat small businesses like large multinationals who were willfully off-shoring profits.  Write to your legislator today and we will see that your message is also sent to the Committee on XXXXXXX.  Let them know how you have been affected by these provisions.

THE WINDFALL ELIMINATION PROVISION FOR SOCIAL SECURITY BENEFITS

ACA advocates for the elimination of the application of the Windfall Elimination Provision (WEP) for US citizens receiving benefits from overseas pensions.  The WEP was originally passed into law to correct a domestic “double dipping” pension problem, itself being challenged by retirees in the United States.  Some retirees can have their US Social Security benefits reduced by 50% by WEP.  Write to your legislators today and we will see that your message is also sent to the Social Security Administration and XXXXXX.  Let them know that the WEP provision should be eliminated for US citizens living and working overseas.

SOCIAL SECURITY ADMINISTRATION OUTREACH TO US CITIZENS OVERSEAS

ACA advocates for Social Security to provide more outreach to the community of Americans overseas through the network of Federal Benefits Units (FBU) and general community outreach.  US citizens living overseas cannot create online Social Security accounts and therefore must deal with te4lephoning or writing to Social Security for updates on their accounts.  Write to your legislators today and we will see that your message is also sent to the XXXXXX.  Let them know your issues with Social Security.

MEDICARE BENEFITS OVERSEAS

ACA advocates for the extension of Medicare benefits to retirees who live overseas.  US citizens who have paid into Medicare cannot access their benefits unless they are receive them in the United States. This encourages citizens to travel back to the US for expensive treatments, which would cost far less in their countries of residence. In addition Premiums are increased, and penalties applied, for those who sign up for Medicare later than when first eligible. SUPPLEMENTAL 3.8 CAPITAL GAINS TAX FUNDING THE AFFORDABLE CARE ACT

ACA advocates for allowing Americans working overseas to credit foreign taxes paid against the supplement 3.8% Net Investment Income Tax (NIIT). The NIIT tax directly funds the Affordable Care Act which Americans overseas cannot access.
