Business Terms and Conditions
(“ACA” means "American Citizens Abroad, Inc." a Delaware non-profit organization.)
 
General
An order is binding as soon as it is submitted and a confirmation email is received. Notwithstanding the foregoing, ACA reserves the right to refuse, cancel, or correct any order, including in cases of typographical, pricing, or administrative errors, and shall have no liability to the member arising from such refusal, cancellation, or correction.
 
Prices
The prices stated are in US Dollars (US$) and apply at the time of the order. ACA reserves the right to correct typographical or clerical errors in stated prices at any time without liability. In the event of a pricing error, ACA may cancel the affected order and refund any amounts paid for that order, which shall constitute ACA’s sole obligation to the member with respect to such error.
 

Methods of Payment
Membership: We accept VISA, MasterCard, US dollar checks, and direct bank transfer.  For direct bank transfers, an additional $15 fee is required for ACA to receive an incoming bank transfer.  Members are also responsible for any additional collection fees charged by their institution.
 
Cancellations
Membership dues are payable one calendar year from the date of renewal/joining. Membership is valid during this year period or over the lifetime of ACA if you are a lifetime member. There are no partial year payments of membership. Membership dues once paid are not refundable. ACA reserves the right to modify, discontinue, or change membership benefits, programs, or services at any time in its sole discretion without liability to any member. ACA shall not be liable for any interruption, suspension, or termination of services or benefits, whether or not such interruption was within ACA’s control.

Not Tax Deductible
Membership dues are not tax deductible under the US Internal Revenue Code.
 
Proprietary Rights
You agree that all right, title and interest (including all copyrights, trademarks, service marks and other intellectual property rights) in and to the ACA Website, belong exclusively to ACA. You agree to ensure that all marks, notices or legends pertaining to the origin, identity or ownership of the Website, or any portions thereof, shall remain intact and clearly legible on any copy of the Website’s content. ACA makes no claim with respect to US government works.
 
Privacy Policy
We take your privacy concerns very seriously. See our Privacy Policy here. No personal member information shall be exchanged outside of ACA management without your prior consent. From time to time ACA management (Board, Country Contacts) may contact you directly with updates and information. ACA shall not be liable for any unauthorized access to, disclosure of, or loss of member information resulting from causes beyond ACA’s reasonable control, including cyberattacks, third-party data breaches, or security incidents attributable to third-party service providers. Members acknowledge and accept the inherent risks of electronic data transmission and storage.
 
Law and Jurisdiction
Any dispute shall be solely governed by and construed in accordance with the domestic laws of the State of Delaware without giving effect to any choice or conflict of law provision or rule (whether of the State of Delaware or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of Delaware.  Joining as a member or acquiring any product or service shall comprise consent to this provision and submission to the jurisdiction. Any and all disputes, claims, or controversies arising out of or relating to these Terms and Conditions or the membership relationship shall be resolved exclusively by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, with proceedings conducted in Washington, D.C. Each party waives any right to a jury trial. ALL CLAIMS MUST BE BROUGHT IN THE MEMBER’S INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION OR REPRESENTATIVE PROCEEDING.
 
Disclaimer of Warranties and Limitation of Liability
THE ACA WEBSITE, CONTENT, PUBLICATIONS, AND ALL MEMBERSHIP SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. ACA DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE. ACA MAKES NO WARRANTY REGARDING THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY INFORMATION, INCLUDING LEGISLATIVE, REGULATORY, OR TAX-RELATED CONTENT, PUBLISHED ON THE WEBSITE OR IN ANY ACA PUBLICATION. MEMBERS RELY ON SUCH INFORMATION AT THEIR OWN RISK AND ARE ENCOURAGED TO SEEK INDEPENDENT PROFESSIONAL ADVICE FOR THEIR SPECIFIC CIRCUMSTANCES. ACA’S TOTAL CUMULATIVE LIABILITY TO ANY MEMBER ARISING OUT OF OR RELATED TO THESE TERMS AND CONDITIONS, REGARDLESS OF THE FORM OF ACTION, SHALL NOT EXCEED THE TOTAL MEMBERSHIP DUES PAID BY THAT MEMBER IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM. IN NO EVENT SHALL ACA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES.
